Form 945, "Annual Return of Withheld Federal Income Tax," is used to report and pay the monies withheld to the IRS. Form 945 is an annual return and is due January 31 of the year following the year in which the taxes are withheld.

Businesses are only required to file Form 945 if they have non-payroll tax liability during the tax year. If no non-payroll payments were made during the tax year, there is no need to file Form 945.

Credit for backup withholding If you had income tax withheld under the backup withholding rule, report the federal income tax withholding (shown on Form 1099 or W-2G) on your return for the year you received the income.

Use Form 1042 to report the following: The tax withheld under chapter 3 on certain income of foreign persons, including nonresident aliens, foreign partnerships, foreign corporations, foreign estates, and foreign trusts. The tax withheld under chapter 4 on withholdable payments.

Essentially, any business that has withheld or was required to withhold federal income tax from a payment that was made outside of their payroll should file Form 945. Businesses are only required to file Form 945 if they have non-payroll tax liability during the tax year.
