Steps in locating a mining claim Locate the claim (discovery) Staking the claim. File the mining claim at the county courthouse and state BLM office. Contact appropriate federal and state agencies to inquire about regulations for exploration, obtaining exploration and mining permits.

The BLM manages 8.4 million surface acres and the USFS manages 14.3 million acres in Colorado. These lands are available for a variety of recreational uses; such as hunting, fishing, wildlife viewing, hiking and camping; along with other authorized uses such as livestock grazing, timber harvest and mineral development.

Mining claims are typically staked on federal lands managed either by the Bureau of Land Management (BLM) or the US Forest Service. In certain situations it is also possible to stake a claim on private land if you seek permission from the landowner and verify that the land has not already been claimed.

Your right to the property is restricted to exploration, development and extraction of a mineral deposit at the site. The surface of almost all unpatented mining claims is not private property; the ownership and management of the surface and surface resources remains with the United States.

To record a mining claim, the claimant must file a copy of the location notice of the claim in the recorders office in the county which the claim lies and with the BLM State Office in Sacramento within 90 days of the location of the claim. The mining claim must be on Federally administered land open to mineral entry.

Remote Recreational Cabin Sites Staking Program: Alaska residents can stake a parcel of state land in a designated RRCS Staking area, lease the land until DNR completes the survey and appraisal, and then purchase the land at market value.

If the claim is patented, you can build on the land. If it is not patented, structure construction is prohibited by law. (Mining claims on state lands are not patented. Prior to building on a state owned claim, a proposal must be made to the governing state agency and written permission granted.

Can I camp on my mining claim and for how long? Whether in a developed campground or at a dispersed site, you may usually camp in an area for up to 14 days before having to move at least 25 miles from your original spot. You may not return to that area for 28 consecutive days. Choose sites that are already established.

Recreational camping is usually allowed on public lands, so if the land where your claim or site is located is open to camping, you can camp there up to 14 days.

With an approved BLM Plan of Operation, a building can be built on the land: any building that benefits and improves the claim, though you cannot permanently live on a mining claim. As stated by the BLM, this can be the "construction of a building, road, fence, or enclosure necessary for mining."
