What is an Incidental Harassment Authorization? An Incidental Harassment Authorization (IHA) authorizes U.S. citizens, engaged in military and non-military readiness activities, to take by harassment a small number of marine mammals for a period of not more than one year.

Level B harassment refers to acts that have the potential to disturb (but not injure) a marine mammal or marine mammal stock in the wild by disrupting behavioral patterns, including, but not limited to, migration, breathing, nursing, breeding, feeding, or sheltering.

The Marine Mammal Protection Act generally prohibits the “take” of marine mammals—including harassment, hunting, capturing, collecting, or killing—in U.S. waters and by U.S. citizens on the high seas.

The ESA also provides for the conservation of the ecosystems on which these species depend. The MMPA was enacted in 1972 and protects all marine mammals, regardless of their status under the ESA. NMFS or the USFWS, as appropriate. coordination with NMFS is recommended to determine if MMPA authorization is needed.

It is not uncommon for dead or distressed marine life, including whales, dolphins, turtles, seals, or sea lions, to wash up on local shorelines. If found, do not approach or touch the animal. The MMPA's primary objective is to: prevent marine mammal species and stocks from diminishing to the point that they are no longer a significant functioning part of their ecosystems and; to restore diminished species and stocks to their optimum sustainable populations.
