Form WH-38 is used by contractors in Oregon to report compliance with Prevailing Wage Rate (PWR) Law. Reporting payroll information is required by Prevailing Wage Rate (PWR) Law, but using form WH-38 is voluntary.

As of July 1, 2022, the current living wage is $14.78 per hour. Effective July 1, 2023, the current living wage will be $15.70 per hour.

The PWR law requires prime contractors to withhold 25 percent of any amount earned by a first-tier subcontractor if the subcontractor does not turn in its certified payroll reports each month. Once the certified payroll reports have been submitted, the prime contractor must pay the 25 percent withheld within 14 days.

A prevailing wage is the basic hourly rate of wages and benefits paid to a number of similarly employed workers in a given geography.

The fee is equal to one tenth of one percent (. 001) of the contract price but must be no less than $100 and no more than $5,000 regardless of the contract price. For further information see OAR 839-025.
