To the extent the employee is allowed direct access, the employer should be present during the employee's on-site inspection of the personnel record to ensure that no files are altered or removed.

An employee's request for personnel documents is often an indication that the employee is upset with some action by the employer and may be considering some type of legal action.

Florida employers may require employees to request access to their personnel files in writing. Although not required by Florida law, employers should provide a form for employees to use.
