Driveway Construction Permit A Right of Way (ROW) Permit is required for the construction of a residential or commercial driveway apron; installation of a temporary construction entrance; restoration, repair, removal and/or modification of any existing driveway.

If your residence is on a State highway, you will need a permit from the NYS Department of Transportation to build or modify a driveway.

Driveways shall provide a minimum unobstructed width of 12 feet (3658 mm) and a minimum unobstructed height of 13 feet, 6 inches (4115 mm). 511.2.
