Early in its history, Arizona adopted the doctrine of prior appropriation to govern the use of surface water. This doctrine is based on the tenet of “first in time, first in right” which means the person who first puts the water to a beneficial use acquires a right that is senior to later appropriators of the water.

An extinguishment credit is created when an existing grandfathered groundwater right is extinguished pursuant to a process established by DWR in administrative rule. The credit reflects an amount of groundwater that may be withdrawn and pledged to a certificate or designation of assured water supply.

What's the main difference between an assured and an adequate water supply? An assured water supply must be proven before building in an AMA. An adequate water supply is the standard for many areas outside AMAs.

What is an Assured Water Supply? The Assured Water Supply program is the regulatory program used by the Arizona Department of Water Resources. The Assured Water Supply program was created subsequent to the historic 1980 Groundwater Management Act, and operates within Arizona's five Active Management Areas.

Under the ADWR's assured water supply rules, groundwater is “physically available” for 100 years if it will be withdrawn from depths that do not exceed 1,000 feet below the land surface in the Phoenix and Tucson AMAs. The maximum is 1,100 feet in the Pinal AMA, or depth to bedrock, whichever is shallower.
