Generally, separate property is: Anything you earned or owned (or a debt) from before you married or after you separated. Anything you buy with separate property or you earn from separate property. Gifts or inheritance (to one of you) even if it was given or inherited when you were married.

Any assets used for both you and your spouse (such as vehicles, retirement accounts, etc.) or purchased through shared accounts, even if purchased by you, will usually be considered communal property.

If real estate qualifies as separate property, a married individual may take title in his or her name alone. The deed should recite that the property belongs to that spouse as separate property. Although not a strict legal requirement, it is best practice for both spouses to also sign a Separate Property Agreement.

Like many states, Texas allows you to take a shorter route through probate if your loved one's estate is below a certain value threshold. In Texas, that value is $75,000. Unlike other states, however, Texas has an additional requirement to qualify as a small estate: Your loved one must not have left a will.

In review, separate property becomes community property through two common scenarios: commingling and transmutation. If you are concerned about keeping property legally separate, be sure to avoid unintentional commingling, and certainly avoid transmutation.
