How ACC processes “sensitive claims” (mental harm caused by sexual abuse) The ACC scheme provides cover for mental harm caused by rape and sexual abuse. ACC calls these types of claims “sensitive claims”, and they're dealt with by a special ACC unit – the Sensitive Claims Unit.

You claim by lodging an ACC 45 Injury Claim Form. The form must always be completed by a treatment provider such as a doctor, physiotherapist or ambulance driver. Usually they will send the form to ACC for you. This is often done electronically.

Minimum and maximum rates of compensation the maximum rate of weekly compensation payable will be $2,163.70. the minimum rate of weekly compensation payable to a full-time earner will be $726.40. This is equal to 80% of the adult minimum wage of $908.00 for a forty-hour week.

We pay weekly compensation of up to 80% of your earnings. If your doctor considers that you can't work because of total inability, excessive risk, or available work tasks, then the amount is based on 80% of your weekly income before the injury prevented you from being able to work.

If you're injured in an accident, make sure you go and see your doctor or health provider first. They can make a claim for you. Claims can be made up to 12 months after your injury. We may still consider claims made after this time if there's a good reason for the claim not being made sooner.

A medical practitioner or nurse practitioner can issue a medical certificate as part of the initial ACC45 injury claim, which covers your patient for up to the first 14 days. The ACC18 can be used to certify beyond the first 14 days.

If your employee is unable to return to their full pre-injury role, ACC weekly compensation is paid at 80% of their average weekly income, as assessed by ACC at DOFI.

Eligible claimants receive 80 per cent of lost earnings or loss of potential earnings at 80 per cent of the minimum wage.
