Many states allow an individual to expunge records of conviction for misdemeanors and even for certain lesser felonies. The State of Nebraska, however, does not allow any convictions to be expunged.

Not more than once every 10 years after an individual has been placed on the central registry for a conviction, the individual may make a motion to the convicting court to request removal from the central registry.

Criminal records can be set aside if the defendant was sentenced to probation or ordered to pay a fine. Misdemeanor crimes can be pardoned three years after a sentence has been completed. Felony crimes can be pardoned ten years after the sentence was completed.

Up to 2 felony convictions will automatically be expunged the later of 10 years after sentencing or the person's release from custody. Up to 4 misdemeanors will automatically be expunged 7 years after sentencing.

The actual financial cost of expungement is minimal. To have a record expunged, the individual is responsible for fingerprinting, getting a certified copy of each conviction that will be requested for expungement, and paying a $50 fee (money order or cashier's check) payable to the State of Michigan.

A petition for removal from the registry must be filed in the family court in the county in which the substantiation occurred. A copy of the petition must be served on the Division of Family Services. The division may file an objection or answer to the petition within 30 days after being served.

The work of CPS (Child Protective Services) is to investigate child abuse and neglect. Because of that, a CPS case conviction for child abuse or neglect will stay on your record for ten years after the youngest child in the report turns eighteen.

The decision to amend/expunge must be made by a children's services supervisor. The individual must be notified via the DHS 1200c, Confirmed Case Amendment Action or the DHHS- 1200, Child/Abuse Neglect - Central Registry Expunction Action.
