Notice to Appear (NTA) policy memorandum (PM) (PDF, 599.37 KB) providing guidance on when USCIS may issue Form I-862, Notice to Appear. An NTA is a document that instructs an individual to appear before an immigration judge. This is the first step in starting removal proceedings against them.

Essentially, this is a relatively short, procedural hearing in which the parties will meet with a judge to determine how exactly the case will proceed. You will not be deported at a Master Calendar hearing. However, in some cases, a person may be detained.

The Notice to Appear (NTA) is the official document that starts removal proceedings against a foreign national. It will require them to appear in immigration court for the initial Master Calendar hearing. You may receive an NTA by mail or in person, or it may be sent to your attorney.

The Department of Homeland Security (DHS) uses a Notice to Appear, or. “NTA,” to explain why it wants to deport you. Everyone in immigration. proceedings receives an NTA. If you lose your NTA, tell the Immigration Judge that you need a copy of it at your first hearing.

USCIS, U.S. Immigration and Customs Enforcement (ICE) and U.S. Customs and Border Protection (CBP) have the authority to issue Form I-826, Notice to Appear which would then be filed in an immigration court after which removal proceedings will be initiated.

The Department of Homeland Security initiates removal proceedings by filing a Notice to Appear, also known as Form I-862, with the immigration court. The notice includes several components: A description of the nature of the proceedings. The legal authority under which the action is being brought.

If you receive an NTA, it means that you must appear in immigration court (before an immigration court judge, and defending yourself against charges made by an attorney representing the U.S. government) on the date specified or at a date to be determined in the future.

1. U.S. Immigration and Customs Enforcement (ICE): The ICE conducts investigations in immigration matters, and enforces immigration laws in removal proceedings. ICE can issue NTAs, and their trial attorneys represent the government in removal proceedings against aliens, sort like a prosecutor.
