Lien Release: After a lien has been filed, the California claimant can release or cancel the lien by filing a Mechanics Lien Release form with the county recorder's office where the lien was originally recorded.

Illinois lien waivers are not required to be notarized in order to be effective.

Contractors, as well as subcontractors and material suppliers can file an Illinois construction lien. If a company does not have a contract with the owner or with the contractor, they are not eligible to file an Illinois mechanics lien claim.

In Illinois, the lien must be verified by the subcontractor with an affidavit, and must include a statement detailing the contract, the balance due, and the legal description of the property that you are attaching the lien to.

Get a Final Affidavit of Payment When you make your final payment to the contractor, you can have him sign an Affidavit of Payment, stating that he has paid everyone on the job. This will give you a defense to anyone who later files a lien, and will essentially wipe out the lien.

What is Waiver of Lien to Date form for? This Illinois partial waiver of lien indicates an amount of money received by the contractor and includes the Contractor's Affidavit for the case when the contractor has contracted for labor or materials on the job.

Illinois does not provide or require statutory forms for lien waivers. For an Illinois lien waiver to be valid, it must be completed by an express agreement that clearly states the intent to waive lien rights.

In order to secure the immediate release of the lien, an individual with an interest in the real estate must deposit a sum of money sufficient to pay the total of the amounts claimed in the lien(s) being released, plus fifteen percent of such total (effectively 115% of the amount being claimed in the lien).
