Bankruptcy helps people who can no longer pay their debts get a fresh start by liquidating assets to pay their debts or by creating a repayment plan. Bankruptcy laws also protect financially troubled businesses.

While no specific cash exemption is listed in the federal bankruptcy exemptions, a wildcard exemption allows you to protect up to $1,325 in any property and use up to $12,575 of any unused portion of a homestead exemption to protect money.

If your total monthly income over the course of the next 60 months is less than $7,475 then you pass the means test and you may file a Chapter 7 bankruptcy. If it is over $12,475 then you fail the means test and don't have the option of filing Chapter 7.

Personal Property Exemption Ann § 427.010(1) protects: Up to $3,000 worth of household furnishings and clothing. Up to $3,000 worth of tools, equipment, and livestock used in farming. Up to $2,500 of equity in 1 motor vehicle with accessories, including 1 spare tire.

Upon filing, the court will assume legal control of your debts and any property not covered by your Kentucky exemptions. A trustee will be appointed to your case by the court. The job of the trustee is to see that your creditors are paid as much as possible.

Again, there's no minimum or maximum amount of unsecured debt required to file Chapter 7 bankruptcy. In fact, your amount of debt doesn't affect your eligibility at all. You can file as long as you pass the means test.

The U.S. bankruptcy code doesn't specify a minimum dollar amount someone must owe to make them eligible for a qualified filing. In short, any debt is enough debt. More important than the size of your debt is the size of your income. How much money you earn affects whether you qualify for Chapter 7.

With Chapter 13 bankruptcy, you must meet certain strict debt limits. Anyone with debts over the amounts listed will not be eligible for Chapter 13 and must file for Chapter 7 instead. To file Chapter 13 an individual must have no more than $336,900 in unsecured debts and no more than $1,010,650 in secured debt.

The Regulations amend the Bankruptcy Regulations to prescribe a statutory minimum bankruptcy threshold of $10,000 with a commencement date of 1 January 2021. This means the bankruptcy threshold of $10,000 applies to bankruptcy notices issued, or creditors' petitions presented, on or after this commencement date.
