Dear (Creditor's Name), I am writing to formally request the cessation of wage garnishment related to my account number (Your Account Number). Due to (briefly explain your situation, eg, ``a recent job loss'' or ``significant financial hardship''), I am unable to meet my current financial obligations.

Usually, a form will be included with the garnishment notice that you can use to write your objection and request a hearing. If it isn't, ask for one from the clerk of the court that sent you the garnishment notice.

If you choose to write a letter, it should be addressed to the creditor, and should include: (i) your name; (ii) the account number; and (iii) a statement that you are revoking the wage assignment, such as, "I am revoking the wage assignment."

Respond promptly to the court order (if the order requires). The employer must return a statutory response form within the required amount of time (set by the court order). The form is typically sent to the employer with the garnishment order. Respond quickly to avoid the risk of a court-issued penalty.

The garnishment law allows up to 50 percent of a worker's disposable earnings to be garnished for these purposes if the worker is supporting another spouse or child, or up to 60 percent if the worker is not. An additional 5 percent may be garnished for support payments more than 12 weeks in arrears.

You can reply to show the court clarifying facts, documents, or other evidence to support your Claim of Exemption. Your reply must be filed at least five court days before the hearing.
