The authors of a joint work are co-owners of copyright in the work. Joint copyright owners share an equal interest in the copyright regardless of how much they contribute to the work. This gives all joint copyright owners the right to register as well as enforce the copyright.

In order to request these services online, simply visit the CIPO website (.cipo.ic.gc.ca/copyrights), then fill out and send the appropriate form. The CIPO website also has copyright forms available for download that can be completed and sent by regular mail.

The assignment must be done in writing to be valid. Although notarization isn't required, it's a good idea to have someone witness the assignor and assignee signing and dating the agreement. Transfer of ownership usually involves monetary exchange, although that's not a requirement.

If you want to reuse a work protected by copyright as a whole or any 'substantial part' of it, in principle you need to get permission from the copyright owner. This means identifying who owns copyright in the work you want to reuse and get a licence from them.

Using the Recordation System. The new Recordation System allows users to electronically submit transfers of copyright ownership and other documents pertaining to a copyright for recordation. Use of the Recordation System is optional and is governed by 37 CFR § 201.4(h) and the Special Pilot Program Rules.

A transfer of copyright ownership, other than by opera- tion of law, is not valid unless an instrument of conveyance (for example, contract, bond, or deed) or a note or memo- randum of the transfer is in writing and is signed by the owner of the rights conveyed or the owner's duly authorized agent.

Generally, when ownership of IP is transferred, it would mean that the right to make any future transfer is also included. But in case of assignment for a fixed term, the agreement can provide for a restriction on the right of the assignee to make future transfers during the term of the agreement.
