Some states authorize their Notaries to perform an act known as “signature witnessing” or “attesting a signature.” This act can be confusing for Notaries because it is similar to an acknowledgment. However, acknowledgments and signature witnessings are separate acts with different requirements.

Starting August 1, 2024, Illinois residents applying to be Notary Public or Electronic Notary Public must use our online application. Those who qualify for a hardship exemption can choose to use a paper application.

Attestation is the act of witnessing the signing of a formal document and then also signing it to verify that it was properly signed by those bound by its contents. Attestation is a legal acknowledgment of the authenticity of a document and a verification that proper processes were followed.

The attesting witness must swear or affirm to knowing the signer of the instrument and to being present when the document was signed. Some states may have more specific requirements. Mere acknowledgment by the witness of having seen the instrument signed by the grantor is not always sufficient.

Attestation often requires the use of a notary public or other qualified official. In some cases, attestation may require signing for an event or action to be verified and affirmed as true.

The taking of an acknowledgment consists of positively identifying the signer of a document. The signer need not sign in the notary's presence but must personally appear before the notary and state that the signature on the document is his or hers.

A notarized document can become invalid due to clerical errors, missing signatures, or improper notary procedures. Mistakes like failing to verify the signer's identity with a government-issued ID, inaccuracies in critical details, or missing signatures can compromise a document's integrity.
