Not recording a deed can cause problems for the grantee. They may be unable to obtain a mortgage, insure the property, or sell it. Even more problematic, an unrecorded deed may make it possible for the grantor to sell the property to a buyer and subsequently sell the same property to a different buyer.

In California, an unrecorded interest is valid between the parties thereto and those who have notice thereof. (Civ. Code § 1217.) Just because a deed is unrecorded doesn't mean it isn't valid.

An assignment of mortgage does need to be recorded in a county clerk's office – or other public records office – to be legally enforceable. If the assignment or mortgage isn't recorded properly, the ownership of the mortgage could be challenged in the future.

Oklahoma imposes a different statute of limitations depending on the type of debt involved: the statute of limitations for an action on a contract not in writing, either express or implied, is three years, while actions on written contracts have a statute of limitations period of five years.
