For jury instructions to be effective, they must be clear and simple. Sentences should be short; instruc- • tions should contain no more than a few sentences, cover only one topic, and be directly related to the circumstances of the case (they should not be abstract statements of the law).

How do I find jury instructions? First, click on Secondary Sources under the Content Types tab on the main Westlaw Edge page. Then, click on Jury Instructions.

Either before or after the closing arguments by the lawyers, the judge will explain the law that applies to the case to you. This is the judge's instruction to the jury. You have to apply that law to the facts, as you have heard them, in arriving at your verdict.

While, in some circumstances, a party may cure its lack of objection at trial through a post-trial motion, that generally is not the case with jury instructions. The specific objection must be made at trial before the instructions are read to the jury; a general objection will not suffice.

A party who objects to an instruction or the failure to give an instruction must do so on the record, stating distinctly the matter objected to and the grounds for the objection.

The law requires all qualified individuals be available to serve as jurors. No person who is qualified and able to serve may be excluded on the basis of age, disability, religion, national origin, sex, sexual orientation, marital status, family status, income, ancestry or physical condition.

How to object Stand up as a sign of respect to the court. It also makes it easier to see that you are objecting. Say “Objection,” and then state your objection clearly and concisely. You can interrupt a witness, if necessary when raising your objection. The judge will rule on the objection.

The answer is simple: The law doesn't allow it. The lengthy instructions, which the judge read to jurors right before they started deliberating, are meant to serve as a road map and to help them apply the relevant law to the facts as they have found them.

When a party has the burden of proving any claim or affirmative defense by a preponderance of the evidence, it means you must be persuaded by the evidence that the claim or affirmative defense is more probably true than not true.
