A custodial parent may file a petition with their local child support agency. That petition will then be forwarded to the New York City Law Department office in the county where the non-custodial parent resides. This matter will then be litigated in the New York City Family Court located in the same borough.

The person serving the summons must read and complete the form “Affidavit of Service”, have it notarized, and returned to you (the petitioner). Provide the Affidavit of Service directly to the Family Court either by mail, email, the NYS Court Electronic Document Delivery System (EDDS), or in person.

In certain cases of willful nonpayment of child support, the delinquent parent may go to jail for up to six months. Noncustodial parents who owe child support arrears equal to or more than four months of current support may be eligible to have their state-issued licenses suspended through the court process.

Only a petition to terminate child support in NY cancels the payments after the court reviews the specific circumstances used as grounds for termination. However, either one of the parents can request a modification to the settlement if there is a significant change in the earnings of the noncustodial parent.
