Your words/illustrations/creations used to bring an Idea to life are considered the copyrightable expression. This is why, in general, blank forms are not protectable under copyright law whereas completed-filled-in forms would be protectable.

A transfer of copyright rights is usually either an assignment or a license. An assignment of copyright rights is like the sale of personal property. The original owner sells its rights to a third party, and can no longer exercise control over how the third party uses those rights.

There are only four simple components you need to include: The copyright symbol © or the word “copyright” The name of the copyright owner or author of the work. The year the content was published, which can be different from the year of creation.

A valid assignment of copyright must be in writing and signed by, or on behalf of, the copyright owner/assignor. The subject of the assignment must be clear as to what copyright is being assigned in which work(s).

Form and Placement of the Copyright Notice: The symbol © (the letter C in a circle), or the word "Copyright" or the abbreviation "Copr."; The year of first publication of the work; and. The name of the owner of copyright in the work.

Assignments must: Be in writing: Unlike some other contracts, oral assignments or oral agreements to assign patent/patent application rights are rarely enforceable. Clearly identify all parties: Recite names, addresses and relationship of both the assignor(s) and assignee.

Using the Recordation System. The new Recordation System allows users to electronically submit transfers of copyright ownership and other documents pertaining to a copyright for recordation. Use of the Recordation System is optional and is governed by 37 CFR § 201.4(h) and the Special Pilot Program Rules.

Copyright Licensing Rules If economic rights are transferred, the transfer must be in writing and signed by the copyright holder. However, if the right is transferred on a non-exclusive basis, no writing is needed.

Trademark assignments must be in writing. The recording date of a document is the date it is filed with the USPTO. There may be assignments that are in whole or others that are considered to be partial assignments. This can become complicated if more than one person owns the trademark.
