To give rise to a claim under the Colorado Lemon Law, a nonconformity must occur and be reported within the warranty period of the car, or within one (1) year from the date on which the purchaser received the car, whichever comes first.

Colorado's lemon law covers any defect or condition that substantially impairs the vehicle's use and market value. The law calls such a defect or condition a ?nonconformity.? The law does not cover any nonconformity caused by the consumer abusing, neglecting, or making unauthorized modifications of the vehicle.

When a new vehicle has been purchased with a manufacturer's warranty and it has a defect that substantially impairs its use and market value within one year of purchase and that defect is not repaired after a ?reasonable number of attempts,? the consumer may have recourse under Colorado's Lemon Law.

In some states, used car buyers are also protected, but, unfortunately, Colorado isn't one of those states. As of now, only 6 states have provisions in place for used cars. These states are Rhode Island, New York, New Jersey, Minnesota, Massachusetts and Hawaii.

Before suing under Colorado's lemon laws, the consumer must send a written notice of the defect to the manufacturer by certified mail. Once the notice has been mailed, the consumer must also go through the manufacturer's informal dispute resolution process, if one exists.

A 30 day or 90 day return policy is hard to find on lower-priced products such as laptops or cell phones let alone bigger purchases such as a new or used car where lengthy return policies are pretty much unheard of/non-existent. Sadly, Colorado State laws make no provision for you to return used cars at all.
