Electronic signatures have to meet a few basic conditions to be in compliance with the ESIGN Act: Intent to sign. E-signatures are valid only if both parties show clear intent to sign the document. Consumer consent. Signature attribution. Audit trail. Record retention and consumer disclosure.

Similar to UETA, the E-Sign Act sets essential requirements for the validity of electronic signatures. These include the intent to sign, consent to conduct business electronically, association of the signature with the record, and proper record retention.

Electronic signatures are accepted on most types of local government records in Washington. Only a few document types not normally used by local governments, such as wills and codicils, are not valid if signed electronically. These exceptions are described in RCW 1.80.

The Electronic Signatures in Global and National Commerce Act, otherwise known as the E-Sign Act, states that electronic signatures shouldn't be considered invalid simply because they're electronic. In other words, e-signatures are completely legal and binding. They can hold up in court.

|As with a handwritten signature, a signer must show clear intent to sign an agreement electronically. For example, signers can show intention by using a mouse to draw their signature, typing their name, or clicking an “Accept” button that is clearly labeled.

In this case, a declaration of intent can only be signed by hand on paper or digitally with a qualified electronic signature. A scanned signature is not legally valid here. For documents without a written form requirement, a scanned signature is legally valid.

Digital signatures carry a user's information along with electronic signatures. Electronic signatures do not contain any authentication attached to them. A digital signature secures a document. An electronic signature verifies the document.

Uniform Commercial Code (UCC) filings allow creditors to notify other creditors about a debtor's assets used as collateral for a secured transaction. UCC liens filed with Secretary of State offices act as a public notice by the "creditor" of the creditor's interest in the property.

For an electronic signature to be legally binding under the ESIGN Act, it is recommended that all electronic signature workflows include the following five elements: Intent to sign. Consent to do business electronically. Opt-out clause. Signed copies. Record retention.
