The Electronic Signatures in Global and National Commerce (ESIGN) Act, signed into law in 2000, made e-signatures legal in the federal arena. Elements of a valid e-contract Demonstrate that the signer had definite intent to sign; for example, provide a clear option not to sign. Prove the signer consented to conduct their business electronically. Clearly attribute the signature. Associate, or directly connect, the signature with the document being signed.
