On March 22, 2024, the USPTO adopted a new rule allowing for electronic signatures on all patent-related correspondence. This means that now, for both trademark and patent correspondence, the USPTO will accept electronically signed documents and forms.

The person signing must insert his or her own signature between the forward slash marks, § 1.4(d)(2)(i). The name of the person signing must be printed or typed immediately adjacent (i.e., below, above, or beside) to the S-signature, and be reasonably specific, so the identity of the signer can be readily recognized.

The Electronic Signatures in Global and National Commerce Act, otherwise known as the E-Sign Act, states that electronic signatures shouldn't be considered invalid simply because they're electronic. In other words, e-signatures are completely legal and binding. They can hold up in court.

The S-signature must consist only of letters (including Kanji, etc.), or Arabic numbers, or both, and appropriate spaces, commas, periods, apostrophes, or hyphens for punctuation, § 1.4(d)(2)(i). All of states in the US have adopted the UETA or a modified version thereof which each allows for the assignment of patent rights using a compliant electronic signature. Additionally, the USPTO records scanned or other electronic copies of assignments; originals are not submitted to the USPTO.

For an electronic signature to be considered as advanced, it must meet several requirements: a) The signatory can be uniquely identified and linked to the signature. b) The signatory must have sole control of the private key that was used to create the electronic signature.

Open the email with a request to digitally sign your document. Click the link. Agree to electronic signing. Click each sign tag and follow the instructions to add your electronic signature where required to sign or initial. Adopt a signature to save your signature information. Confirm your signature by clicking FINISH.

Electronic signatures are legally recognized in the United States and are provided for in the Electronic Signatures in Global and National Commerce Act (?ESIGN?) and state and territory versions of the Uniform Electronic Transactions Act (?UETA?).

All that needs to be is some mark that represents you. It can be a series of squiggles, a picture, or even the traditional "X" for people who can't read and write. As long as it records the intent of the parties involved in a contractual agreement, it's a valid signature.
