When an individual with a capacity to understand the legal effects makes a voluntary release in exchange for valuable consideration, the release will be valid. An agreement of release will only be enforceable if it is valid.

To be considered a legally binding contract or document, three critical elements must also be present: Subject, Consideration, and Capacity.

State laws treat release forms as contracts. As long as all parties agree to the terms of the contract, the release agreement is enforceable. There are circumstances when the courts will not enforce a release or a waiver: The agreement violates public policy.
