The Fair Debt Collection Practices Act says debt collectors can't harass, oppress, or abuse you or anyone else they contact. For example, debt collectors can't: Make repeated phone calls that are intended to annoy, abuse, or harass you or any person answering the phone. Use obscene or profane language.

Causing a telephone to ring to harass or annoy a consumer is an express violation of the Fair Debt Collection Practices Act (FDCPA). It is also a violation of the FDCPA for a debt collector to call early in the morning or late at night.

Also, they must not contact the individual within seven days after engaging in a phone conversation about a particular debt.

Similarly, a debt collector must prove the following facts to win their case in court: The debt collection agency owns your debt and has the legal right to sue. You owe the debt. The amount they claim you owe is accurate.

If you choose not to verify your identity by providing information, like your Social Security number, the debt collector will generally ask you for another form of identification, including: Account number for the debt in question, if you know it. Other contact information, such as your current or previous address.

Include your full name, company name, and mailing address. Address the letter to your client by their full name. State the problem: Specify and provide proof of the debt in question. Reference the original contract or agreement that states the services the client owes you for.
