Under RIGL § 12-1 3-4 (c), certain individuals or organizations have access to expunged records. These include: the individual whose record was expunged. a sentencing court following the conviction of the individual for the commission of a different crime.

Generally, a person with two or more convictions cannot expunge a conviction. There is a limited exception, however, where a person otherwise eligible to apply for expungement may do so if he or she has been convicted of not more than two minor offenses in addition to the one sought to be expunged.

An expungement only applies to those found innocent or not convicted. An expungement does not apply to those who have been convicted of a crime, unless the conviction is later overturned or an absolute pardon is granted. Absolute pardons are granted only in rare cases by the governor.

Records that have been expunged are not visible to landlords, bankers, or most employers. If you have your records expunged, you will be able to state legally that the offense never occurred and that the record does not exist.

In order to seal your Virginia record, there is a ten year waiting period for felonies and seven year waiting period for misdemeanors before they are eligible to be sealed. During that time, there can be no new criminal convictions.

Beginning October 1, 2025, you may qualify for automatic sealing of your misdemeanor arrest record if you are found not guilty, if the government drops the case, or if the case is dismissed.

Clean Slate Virginia uses new Virginia sealing laws and existing expungement laws to clear criminal records throughout the entire state of Virginia. When criminal convictions are sealed, they cannot be seen by the public or employers.

To get an expungement, you must file a petition and obtain a certified copy of your arrest warrant or indictment. Both documents should be filed in the Circuit Court where the charges against you were resolved. Then: The petition is served on the Commonwealth's Attorney.
