For consent to treatment to be considered valid, it must be an "informed" consent. The patient must have been given an adequate explanation about the nature of the proposed investigation or treatment and its anticipated outcome as well as the significant risks involved and alternatives available.

Informed Consent Process Generally, the physician who performs the procedure is responsible for obtaining the patient's consent. If a nonphysician will perform the procedure, then the ordering physician is responsible for obtaining consent.

Generally, the duty to obtain informed consent rests with the provider ordering the treatment or procedure even though other health care providers may assist in delivering the treatment or procedure.

Nurse's role The nurse does not receive informed consent from a patient, the provider does. But, the nurse's role is to sign the patient's consent form as a witness.
