It's normally not advisable for parents to add a child to the deed because they can lose their home, or equity in it, if you are involved in legal proceedings such as a divorce or lawsuit against you. Also, it's like gifting half of it to you and that's not a good idea if they are older and may need Medicaid someday.

Unlike some other types of property, you can't just add their name to the existing deed. To add someone to your house title, you must create a new deed that transfers the title of the property to both you and the other person.

For example, you can add your child to your deed if they: Are under age 21; • Are disabled under the Social Security standards; OR • Have lived in the home with you for at least two years AND has cared for you so that without the care, you would have needed to live in a nursing home or hospital.

In South Carolina, the personal representative must execute a deed of distribution with respect to real estate owned by a deceased person in order to transfer or release the estate's ownership or control over the property.

S.C. Code Ann. § 12-24-70 (2014) requires the filing of an affidavit stating the value of the property (with some exceptions) with the clerk of court or the register of deeds. (A)(1) The clerk of court or register of deeds shall require an affidavit showing the value of the realty to be filed with a deed.

– Upon timely application anyone may be permitted to intervene in an action. (1) When a statute confers a conditional right to intervene; or (2) When an applicant's claim or defense and the main action have a question of law or fact in common.

To change, add or remove a name on your deed a new deed needs to be recorded reflecting the change. Many people think they can come into the office and change the present recorded deed with a form, but that is not the case. Once a deed is recorded it cannot be changed.
