The Golden Rule of Mediation is to treat others as you would like to be treated during the negotiation process. A mediation statement should distill the issues in the case. Less is always more. Start with a single paragraph identifying the parties and summarizing the claims. Provide a concise summary of the key facts without the gory details, as objectively as possible.

In very broad terms, all statements made in connection with mediation can be precluded from introduction as evidence at a hearing unless both parties explicitly waive mediation confidentiality. The mediation rules are, in reality, rules of evidence, which is why they are set forth in the California Evidence Code.

Mediation does not require either party to prove the merits of their case. Parties can disagree as to facts or law and still find an acceptable compromise to their dispute.

Mediation is confidential and private, so the other party can't use what you say in mediation against you in court later.
