A transfer of copyright rights is usually either an assignment or a license. An assignment of copyright rights is like the sale of personal property. The original owner sells its rights to a third party, and can no longer exercise control over how the third party uses those rights.

Copyright Assignments The assignment must be signed by the author, or the assignor, to be valid and enforceable. The assignor is the person who transfers ownership of the copyright. The assignee is the person or entity that receives the ownership rights of the work. Why are copyright assignments important?

A valid assignment of copyright must be in writing and signed by, or on behalf of, the copyright owner/assignor. The subject of the assignment must be clear as to what copyright is being assigned in which work(s).

Copyright in a list may exist in the content of the list or in the way that the content was selected and arranged. Copyright does not protect facts, but it does protect opinion. If a source is based on "value judgments", it may be protected by copyright, even if it looks very similar to fact.

There are three requirements for a work to be copyrighted: The work must have the correct subject matter (expression, not just ideas). The work must be fixed in a tangible medium of expression. Works such as choreography and dances must be videotaped to be fixed.

The assignment must be done in writing to be valid. Although notarization isn't required, it's a good idea to have someone witness the assignor and assignee signing and dating the agreement. Transfer of ownership usually involves monetary exchange, although that's not a requirement.

Using the Recordation System. The new Recordation System allows users to electronically submit transfers of copyright ownership and other documents pertaining to a copyright for recordation.
