However, the law does require judges to consider all of the relevant circumstances, including: the requesting spouse's age, physical condition, and emotional condition.

In Kentucky, a person may be disqualified from receiving alimony if they are financially self-sufficient, if the marriage was short, or if they remarry or cohabitate with another partner. The court will also consider both spouses' financial resources when determining eligibility.

While the short answer is that a spouse's bad behavior doesn't affect alimony – there are exceptions. Many times, marital misconduct creates ripples across all parts of a couple's life. If those ripples are provable and significant, it might be considered as part of property division, child support, or alimony.

Either spouse has the right to request alimony, though the judge must find that the requesting spouse doesn't have sufficient resources to be self-supporting and that they are unable to be self-sufficient or cannot work outside the home because they are responsible for caring for a young or incapacitated child.
