The District Judge is the only one that can excuse you from jury duty. Failure to honor the jury summons may subject you to a fine for contempt of court.

Each of the federal district courts has its own rules about jury service. Many federal courts offer excuses from service, on individual request, to designated groups, including people over age 70.

Either before or after the closing arguments by the lawyers, the judge will explain the law that applies to the case to you. This is the judge's instruction to the jury. You have to apply that law to the facts, as you have heard them, in arriving at your verdict.

A good opening statement: Explains what the attorney plans to prove and how they will do it. Presents the events of the case in a clear, orderly sequence. Suggests a motive or emphasize a lack of motive for the crime. Is not argumentative.

The judge will instruct the jury in each separate case as to the law of that case. For example, in each criminal case, the judge will tell the jury, among other things, that a defendant charged with a crime is presumed to be innocent and the burden of proving his guilt beyond a reasonable doubt is upon the Government.

Do work out differences between yourself and other jurors through complete and fair discussions of the evidence and of the judge's instructions. Don't lose your temper, try to bully, or refuse to listen to the opinions of other jurors. Don't mark or write on exhibits or otherwise change or injure them.
