Statutes Text. §17–203. This power of attorney authorizes another person (your agent) to make decisions concerning your property for you (the principal).

The Statement of Probable Cause (form DC/CR 4) is a document used by the arresting officer to write a concise statement that articulates the probable cause related to the arrest of the defendant, including articulating the elements of each crime charged on forms DC/CR002 and DC/CR002A.

In a criminal case, once a finding of guilt has been made, the defendant has 90 days from the date of sentencing to ask the judge to reconsider the sentence given. Under Maryland law, the judge then has 5 years from the date of the request to rule on the motion. The judge may deny the motion without a hearing.

However, if a plaintiff unwittingly entered into an arbitration agreement due to coercion or deception, or if the terms of the arbitration agreement undermine the plaintiff's ability to vindicate their rights, courts can and sometimes do step in and invalidate the contract.

A party is deceived, intimidated, or coerced during the execution of the arbitration agreement and requests a declaration that such arbitration agreement is invalid; and. The arbitration agreement violates prohibitions specified by the law.

Where a third party has a direct relationship to the party which is a signatory to the arbitration agreement, a direct commonality of the subject matter and where composite reference of such parties would serve the ends of justice, third parties may be joined to the arbitration.

A court may refuse to enforce an arbitration agreement if the agreement fails to satisfy California's conscionability standards. (Civ. Code, § 1670.5; Armendariz, 24 Cal. 4th at 114.)

As a general rule, only strong evidence of duress or fraud are sufficient to invalidate an arbitration clause. It is worth noting that many state courts will to set aside arbitration agreements where the parties have vastly disparate bargaining power (such as between employers and employees).
