Debt collectors cannot harass or abuse you. They cannot swear, threaten to illegally harm you or your property, threaten you with illegal actions, or falsely threaten you with actions they do not intend to take. They also cannot make repeated calls over a short period to annoy or harass you.

Can a Debt Collector Collect After 10 Years? In most cases, the statute of limitations for a debt will have passed after 10 years. This means a debt collector may still attempt to pursue it (and you technically do still owe it), but they can't typically take legal action against you.

How long before a debt becomes uncollectible? It depends on the statute of limitations in your state. Typically, this is a period between three and six years. However, it may extend beyond that in some cases.

In Idaho, a collection action based on a written contract must be brought within five years (I.C. § 5-216). If a collection matter is based on an oral contract, the action must be brought within four years (I.C. § 5- 217).

The Fair Debt Collection Practices Act (FDCPA) prohibits debt collectors from using abusive, unfair, or deceptive practices to collect from you. Under the FDCPA, a debt collector is someone who regularly collects debts owed to others.

A creditor must collect on the debt within five years after a court issues a judgment, although a creditor can renew a judgment for additional five year periods.
