As of 2024, Colorado, Iowa, Kansas, Montana, New Hampshire, Texas, Utah, and the District of Columbia are common law marriage states. The following states DID recognize law marriages, and will generally still recognize them if couples satisfied all the requirements BEFORE such marriages were banned.

You are not common law married based on the length of your relationship alone. For example, a common law marriage may be established in one day and a long-term couple may never be common law married. A common law marriage is more than a committed partnership or long-term boyfriend/girlfriend.

If the parties need documentation of a marriage, it is recommended that they file a signed, notarized affidavit, attesting to the marriage, with the County Clerk and Recorder in the county where they reside. This affidavit will be filed as a document, not as a marriage record (sample affidavit follows).

Under C.R.S. 14-10-114, the alimony recipient is only entitled to 40% of the combined adjusted gross income of the parties. As such, the next step is to determine what 40% of that income is. For example, if the wife makes $10,000 per month and the husband makes $5,000 per month, the calculation would be $15,000 times .

The statute referred to, here, is 14-10-114, Colorado Revised Statutes. The statute provides a calculation whereby 40% of the combined income of the Parties minus the lower income is the guideline amount of spousal support that a Court will generally consider awarding.

The guideline states that the paying spouse's support be presumptively 40% of his or her net monthly income, reduced by one-half of the receiving spouse's net monthly income. If child support is an issue, spousal support is calculated after child support is calculated.

If your child support order was issued in Colorado, emancipation occurs and child support ends when the child reaches 19 years of age in most cases. However, if the child is still in high school or an equivalent program, support continues until the end of the month after graduation but not beyond the age of 21.
