The first step in proving incapacity in Maryland is to provide the court with two physician's certificates. The physician's certificates show that the physician has examined the alleged incapacitated adult and provides evidence of the condition that result from the incapacity.

A power of attorney executed on or after October 1, 2010 must be: In writing; AND. Signed by the principal (or some other person, in the physical presence of the principal, and at the express direction of the principal); AND. Acknowledged by the principal in the physical or electronic presence of a notary public; AND.

Maryland law, however, does not make it easy to bring an intention infliction of emotional distress claim. To bring this tort, the plaintiff must demonstrate a “truly devastating effect” from the defendant's behavior. The emotional response must be so awful that “no reasonable person could be expected to endure it.”

A guardian. A health care agent is someone appointed by an individual to make health care decisions. Usually, the health care agent steps in after the individual has lost the ability to make these decisions personally. Most health care agents are appointed through a written document called an advance directive.

Also, at least one of the witnesses must be someone who will not knowingly inherit anything from the Declarant or otherwise knowingly gain a financial benefit from the Declarant's death. Maryland law does not require this document to be notarized.

As mentioned above, in Maryland, you should have your POA notarized and witnessed. The notary public can act as one of the two required witnesses.

In Maryland, a valid will must be (1) in writing, (2) signed, and (3) attested and signed by two credible witnesses. It may be handwritten or typed and any two adults can be witnesses. A will does not require a notary, though a notary can be a witness.
