Except as otherwise provided by law, any party requesting a rule to show cause for a violation of a court order in any civil action in a court of record shall file with the court a motion or petition, which may be on a form prescribed by the Office of the Executive Secretary of the Supreme Court of Virginia.

Mediation can be helpful in resolving legal disputes. It is not legally binding unless the parties enter a settlement agreement, also sometimes referred to as a mediation agreement. Mediation can also be legally binding if it is court-ordered.

A mediator will: Manage the negotiation process. Help clarify the facts and issues. Help the parties analyze what they need out of a resolution and help them generate options to resolve their dispute.

Five days' notice is required to the opposing party and the court. Motions may be typed by either party, may be filed on the General Notice and Motion Form or may be filed on one of the appropriate forms provided by the Supreme Court of Virginia (located here).

The mediator begins by explaining the process and conduct guidelines, and both parents sign the Agreement to Mediate. Each parent shares their concerns and goals.
