Designation of a health care surrogate. (1) A written document designating a surrogate to make health care decisions for a principal or receive health information on behalf of a principal, or both, shall be signed by the principal in the presence of two subscribing adult witnesses.

The Florida next of kin law provides the framework for the distribution of a person's assets after they pass away, in the absence of a will. The law specifies the order in which a person's assets will be distributed among their next of kin, with priority given to spouses, children, and other close relatives.

The health care proxy statute provides the legal ability for the family and others to take over someone's health decisions if the incapacitated person is unable to make health care decisions themselves.

While a named additional surrogate is often advised, the state provides somewhat more opaque guidance on the nomination of multiple attorneys-in-fact. Although there's no law prohibiting the naming of more than one surrogate, doing so isn't typically recommended.

However, under Section 395.3025(1), Florida Statutes, if a personal representative has not been appointed, then "the next of kin of the decedent" is allowed to obtain the decedent's medical records.

If there is no power of attorney or health care surrogate designation signed, then you can rely on the Florida Health Care Proxy statute. Spouses are, by law, allowed to make medical decisions for their spouses when they're incapacitated and no other documentation exists.

No additional registration or certification is required. The out-of-state telehealth provider registration only applies to health care practitioners who are not licensed in Florida and are licensed in another state, the District of Columbia, or a possession or territory of the United States.

Out-of-State Psychologists All psychologists who provide services in Florida need Florida licenses unless they fall under an exemption category. Nonresident psychologists who hold licensing in their own state may practice up to five days in a month and fifteen total days in a year pursuant to statute 490.014.

Section 456.47, F.S., enacted by the Legislature in 2019, authorizes the use of telehealth for all practitioners, within the applicable scope of practice, and regulates the use of telehealth by out-of-state health care providers. This licensure statute clarifies that the use of telehealth is not limited to physicians.
