In a strict liability claim, the plaintiff must prove that the product was defective by virtue of being “unreasonably dangerous” despite precautions taken by the manufacturer in its manufacture or design.

In order to succeed on a claim for strict product liability, a plaintiff must show that: (1) the product was defective (2) when it left the defendant's hand, and that (3) the defect caused the plaintiff's injury.

Generally, to prevail on a strict product liability claim, a plaintiff must prove that an inherent defect in a product caused the damages claimed. In other words, the plaintiff must prove (1) that the product was inherently defective and (2) that the defect in the product caused the injury or damage.

For courts that use strict liability, you don't need to show that the manufacturer was negligent—only that their product led to your injuries. Stated differently, the strict liability doctrine is more concerned with the product itself and less concerned with the manufacturer's actions.

If the test for strict liability is met, the manufacturer can be held liable even if they were not negligent. In general, for strict product liability, someone has to show that: The product had a defect. The defect made the product unreasonably dangerous.

To win a strict liability case, first, you must be injured. Second, you must prove that the defendant's product or actions caused the injury. As long as their conduct resulted in your injuries and the case falls under strict liability rules, you can make a claim for your damages without having to demonstrate fault.

An attorney representing a party who will not be filing a document shall enter a separate notice of appearance as counsel of record indicating the name of the party represented. A separate notice of appearance shall also be entered whenever an attorney is substituted as counsel of record in a particular case.

In alleging fraud or mistake, a party must state with particularity the circumstances constituting fraud or mistake. Malice, intent, knowledge, and other conditions of a person's mind may be alleged generally.

All civil motions shall be governed, where applicable, by Superior Court Rules 9A through 9E. Any criminal motion must be in writing and filed before being placed upon a list for hearing, unless otherwise ordered by the court, or otherwise provided for under Superior Court Rule 61.
