After trial is commenced, at any time prior to the rendering of a verdict, the court may declare a mistrial on its own motion or on motion of any party if it determines an occurrence at trial has prevented a fair trial.

Joinder of offenses. Any two or more offenses committed by the same defendant: (a) may be joined in one accusatory instrument, with each offense stated in a separate count; or. (b) may be joined for trial, upon the application of the prosecuting attorney or the defense.

In every trial the testimony of witnesses must be taken orally in open court, unless otherwise provided by a statute or by these rules, the Idaho Rules of Evidence, or other rules adopted by the Idaho Supreme Court.

The parties to any action may present to the court a stipulation about any procedural matter involved in any proceeding, including a stipulation to vacate or continue a hearing or trial. A stipulation is considered as a joint motion by the parties to the court for its consideration, and is not binding on the court.

(b) For Production of Documentary Evidence and of Objects. A subpoena may also command the person to whom it is directed to produce the books, papers, documents or other objects designated in it. The court, on motion, may quash or modify the subpoena if compliance would be unreasonable or oppressive.

After giving any notice it considers appropriate, the court may at any time correct a clerical error in a judgment, order, or other part of the record, or correct an error in the record arising from oversight or omission.

Taking Testimony. In every trial the testimony of witnesses must be taken in open court, unless otherwise provided by a statute or by rules adopted under 28 U.S.C. §§2072–2077.
