Sec. 5. In an action based on fault, any contributory fault chargeable to the claimant diminishes proportionately the amount awarded as compensatory damages for an injury attributable to the claimant's contributory fault, but does not bar recovery except as provided in section 6 of this chapter.

In India, the appropriate court for the enforcement of foreign arbitral awards is the High Court of the respective states. The process typically has two stages: filing an application under Section 48 or Section 59 of the Arbitration and Conciliation Act, 1996.

Once the decree is awarded, the decree holder can apply for execution or enforcement after 90 days of passing of award. The decree may be executed either by the court which passed it, or by the court to which it is sent for execution.
