A copyright assignment is the transfer of copyright ownership rights from one party to another. This transfer is not valid unless it is in writing and signed by the owner or its authorized agent. If you want to transfer a right on a non-exclusive basis, a written agreement is usually not required.

Using the Recordation System. The new Recordation System allows users to electronically submit transfers of copyright ownership and other documents pertaining to a copyright for recordation. Use of the Recordation System is optional and is governed by 37 CFR § 201.4(h) and the Special Pilot Program Rules.

No special forms are needed for recordation, although the USCO does encourage registrants to use a “Document Cover Sheet” to facilitate such recordings.

A valid assignment of copyright must be in writing and signed by, or on behalf of, the copyright owner/assignor. The subject of the assignment must be clear as to what copyright is being assigned in which work(s).

In an assignment of copyright rights, the owner sells his or her ownership rights to another party and has no control over how the third party uses those rights. A copyright assignment is sometimes referred to as a sales agreement for copyright.

IP can change ownership several times, and intellectual property assignment is the process of an IP owner transferring those rights to another party. This transfer is complete and irrevocable, meaning the original owner gives up all claims to the IP once the assignment is done.
