Every executor and administrator shall have nine (9) months from the date of his or her appointment for the settlement of the estate. An administrator de bonis non shall have such time, not exceeding nine (9) months as the court may determine.

The small estates affidavit can be used to transfer up to $75,000 in assets to heirs without filing a probate case in court. The affidavit is NOT filed with the court (or the Judicial Council). It is prepared and presented to the holder of the assets.

Probate is not required unless there is at least one asset “stuck” in the name of the decedent only, with no beneficiaries being named on that asset.
