This bill exempts gambling losses from the limitation on itemized deductions for Oklahoma income tax purposes, effective November 1, 2023. The bill amends the Oklahoma Income Tax Act to allow individual taxpayers to deduct gambling losses, which were previously subject to the $17,000 cap on itemized deductions.

For taxpayers who maintain more than one residence and divide their time between those residences, the dwelling in which they spend more time would qualify as their principal residences.

A Resident is an individual that is domiciled in the state for the entire year. A Nonresident is an individual that was not domiciled in the state at any time during the tax year. A Part-Year Resident is an individual whose domicile was in Oklahoma for less than 12 months during the tax year.

(d) An acceptable residency document is: (1) Rental or lease agreement with the signature of the owner/landlord and the tenant/resident. (2) Deed or title to residential real property. (3) Mortgage bill. (4) Home utility bill including cellular phone bill.
