Rule 9 deals with arrest procedures after an information has been filed or an indictment returned. The present rule gives the prosecutor the authority to decide whether a summons or a warrant shall issue.

In addition, Rule 5 also provides that even where the parties are unable to reach agreement on all issues or where the court finds the agreement unacceptable, the structuring conference will be held telephonically unless the court specifically orders that counsel and/or the parties appear in court for the conference.

Rule 9. Answers; Defenses; Forms of Denials. (a) An Answer or other responsive pleading shall be filed with the court within 30 days after the person filing said pleading has been served with the pleading to which the Answer or response is made.

During the time a case is pending in the trial court, all exhibits submitted at trial, hearing or other proceeding shall be maintained by the court, except that the court may order exhibits requiring special security handling (firearms, drugs, other contraband, etc.)

Failure to attend court will result in either the judge trying you in your absence, which will very likely result in the judge finding you guilty in your absence, issuance of a show cause, and/or a capias being issued. A capias is a warrant for your arrest.

The opening statement shall be limited to fifteen minutes, unless the court for cause shown shall extend the time. The court in its discretion may permit, or in a civil action require, a defendant to make an opening statement of his defense before any evidence is introduced.

(4) Any indigent defendant who wishes to be represented in the supreme court by court-appointed counsel, including indigent defendants who were represented in the trial court by court-appointed counsel, must file a current Request for a Lawyer form with the supreme court.
