When written correctly, a photography contract is legally binding and will describe the responsibilities and rights of both the client and the photographer. It's important to make sure your contract is written in such a way that it will be valid in multiple scenarios.

A written Cancellation of Contract form is a great evidentiary document to use to prove the terms and conditions of the cancellation. If your contract has a cancellation provision, then make sure any Cancellation of Contract form used mirrors the language contained in the original contract.

A photo licensing agreement is a contract between two parties, the licensor (the photographer who owns the copyright and is licensing the rights to use the image) and the licensee (the person or company wanting to and gaining the right to use the image).

A cancellation clause states that in the unlikely event your client cancels the wedding or portrait session, the retainer is non-refundable. It further explains that if they cancel a wedding/session within "x" days, the full amount is due.

The time frame you give is up to you and your personal preferences for how long you would like to tentatively hold that date for the client. You can choose to give them a few days to complete or up to one week, depending on the session type you are shooting.

By including a liability limitation section in your contract, you protect yourself from unexpected occurrences such as natural disasters, or personal illness. It's also a good idea to state in this section if you will provide a replacement photographer in such cases, and/or provide a full or partial refund.

Indemnification: This is a fancy word that means a simple thing: the parties won't hold each other legally liable for anything outside of the contract (and each party handles their own liability). So if the client's kid breaks a vase at a venue you're shooting at, it's 100% their responsibility to pay, not yours.
