It is generally recommended that you revisit your estate plan at least once every five years, just to make sure that everything is still relevant and no changes are needed. If it has been a while since you looked at your power of attorney, here are some questions to consider when deciding whether you should update it.

In most cases, a person (the principal) who has appointed someone else to act as their attorney may revoke that power at any time if they wish, if they have legal capacity. However, an irrevocable power of attorney can only be revoked in very limited circumstances for example if the attorney consents.

This is why it is important that you review and sign a new power of attorney every few years. There is no set rule of how often you should resign one, but if you want to make sure you are safe, every 3 years would be prudent. You don't have to go to a lawyer to draft you a new one every time.

Once the power of attorney is invoked, it usually is irrevocable unless the principal regains their capacity to make decisions for themselves and can revoke the power of attorney; otherwise it does not expire until the principal's death.

As a general rule though, it is a good idea to review your medical directive and durable power of attorney the sooner of every three (3) to five (5) years or every time you experience a life changing event.

The document is flexible and can be prepared to meet your specific needs. It can be effective immediately or only when you are unable to manage your own affairs. Yet, even if you have a power of attorney in place, it is important to review it periodically, and potentially replace it with a new document.

While any new power of attorney should state that old powers of attorney are revoked, you should also put the revocation in writing.Sign the document and send it to your old agent as well as any institutions or agencies that have a copy of the power of attorney.
