If, after 30 days, the landlord has not returned your security deposit, you can file a complaint against the landlord in Small Claims Court.

Under New Jersey landlord-tenant law, landlords may charge the equivalent of one and one-half months' rent for the security deposit. Any additional security deposit, collected annually, may be no greater than 10% of the current security deposit.

If the landlord does not return the security deposit within 30 days from the date the tenant moves out or vacates the premises, the tenant may sue to recover double the amount due, plus court costs and reasonable attorney's fees, if any.

The landlord is required by law to invest the rental deposit in an interest-bearing account. Any interest accrued is returned to the tenant along with the deposit when they vacate the property. Any repairs the landlord has to carry out during the tenancy is deducted from the deposit.

The landlord is required to pay the tenant the interest or the earnings generated on their security deposit annually. If the tenant wishes, they can have this amount credited toward their next month's rent instead.

The person paying the security deposit would credit the asset account Cash and would debit the asset account Security Deposits. The person receiving the security deposit would debit the asset account Cash and would credit the liability account Security Deposits Returnable.
