In almost all cases, an individual must be the age of majority, 18 years old, to form and agree to an enforceable contract. Minors, those under the age of 18, have no capacity to contract. The type of contract can also affect the legal contract age.

After the voting age was lowered in 1971 from 21 to 18, the age of majority was lowered to 18 in many states. In most US states, one may obtain a driver's license, consent to sexual activity, and gain full-time employment at age 16 even though the current age of majority is 18 in most states.

Minors are not considered to have legal capacity, meaning they do not have the ability to make contracts with other people. If a minor signs a contract, they have the ability to void the deal with certain exceptions. For instance, a minor cannot void a contract for an item that is considered a necessity: Food.
